Welcome to Ministry of Agriculture and farmers welfare ("Company", "we","our","us")! These Terms of Service (“Terms", “Terms of Service"), govern your use of our website located at https://soilhealth.dac.gov.in together or individually “Service” operated by Ministry of Agriculture and farmers welfare.
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.
Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.
If you do not agree with (or cannot comply with) Agreements,then you may not use the Service, but please let us know by emailing at soilhealthcard.support@krishitantra.com so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.
Soil Health Card mobile application for Android is available in the Google play store Link managed by Krishitantra (Klonec automation systems pvt ltd) in the name of Soil Health Card.

2. Types of Information We Collect

We may collect the following information from you:

Personal details (e.g., name, contact details including mobile number, residential address, and document such as PAN) provided by you to us to avail various services from us.
Land details (e.g., Land address, survey number, location, crop details, details of fertilizers applied, etc.) needed as part of the request for some of our services.
Land images/photos required to avail any of our services.
Details provided by you to us by way of feedback or responses to surveys.
Information obtained from your mobile device by way of using our app, like device location and communication information including phone number.
Access to your mobile camera device for the functioning of in-app functionalities, such as scanning QR codes for soil sample collection, land images, etc.
Access to files from your mobile device, such as images and PDF files, for the functioning of in-app functionalities, including storage of soil health cards, import/export of collected sample data in offline mode, exporting progress reports, etc.
Access to WiFi details/GPRS connectivity to identify the offline or online mode of app operation.

3. Sharing and Storage of Your Personal Data

Any Personal Data that we have access to shall never be shared without your consent. In various processes/submission of applications /availment of product /service offerings, we even seek your explicit consent to use /share your Personal Data. In our business and operational processes, we only share the data on a partial and"need-to know" bais to designated personnel or partners or service providers.

We may process,store and retain your Personal Data on our servers where the data centers are located, and/or on the servers of third parties having contractual relationships with us,All Sensitive Personal Data is stored in India. We will retain your data for the period that you continue to be our users and for such period as required to comply with any obligation under any law for the time being force.

We will share your data with competent/legal/statutory/regulatory agencies/authorities or partners/service providers acting on our behalf(as the case may be) in following cases:

For enabling the provision of the services availed by you, strictly on a "need to know" basis and subject to applicable laws.
Where it is directed or required by legal/regulatory/statutory/governmental authorities/judiciary under any applicable laws/regulations or judicial pronouncement through a legally obligated request.

When you make use of our services, we may collect and store information about you to process your requests automatically complete forms for future transactions including (but not limited to) your phone number,address, email, etc. This information may be shared with third-parties which assist processing and fulfilling your requests, and for providing you with products / services to better serve your needs and interests. Such sharing shall be in accordance with your instruction, and subject to appropriate confidentiality and security requirements.

4. Usage of Your Personal Data

We use your Personal Data in our analyics for providing other designated agriculture departments to perform, among other actions, the following:

To facilitate the generation of soil health card or report on the soil health card related services;
To undertake research and analytics for offering or improving our services and their security and service quality;
To check and process your requirements submitted to us for services and / or instructions or requests received from you in respect of these services;
To share with you, updates on changes to the services and their terms and conditions including platforms terms and conditions;
To take up or investigate any complaints / claims /disputes;
To respond to your queries or feedback submitted by you;
To verify your identity for us to provide services to you;
To carry screenings or due diligence checks as lawfully required by us;
To monitor and review services from time to time;
To undertake financial / regulatory / management reporting, and create and maintain various risk management models;
To conduct audits and for record keeping purposes;
To comply with the requirements of applicable laws /regulations and / or court orders / regulatory directives received by us;

5. Communications

By using our Service, you agree to subscribe to newsletters,marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all,of these communications from us by following the unsubscribe link or by emailing at soilhealthcard.support@krishitantra.com.

6.Contests, Sweepstakes and Promotions

Any contests, sweepstakes or other promotions (collectively,“Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.

We take no responsibility and assume no liability for Content you or any third party posts on or through Service. You agree that this license includes the right for us to make your Content available to other users of Service, who may also use your Content subject to these Terms.

Ministry of Agriculture and farmers welfare has the right but not the obligation to monitor and edit all Content provided by users. In addition, Content found on or through this Service are the property of Ministry of Agriculture and farmers welfare or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy,or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

8. Prohibited Uses

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use Service:

In any way that violates any applicable national or international law or regulation.
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.

To impersonate or attempt to impersonate Ministry of Agriculture and farmers welfare, any Ministry of Agriculture and farmers welfare employee, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Service, or which otherwise violates any applicable law or regulation.

Additionally, you agree not to:

Use our Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party's use of Service, including their ability to engage in real time activities through Service.
Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.
Use any means to obtain unauthorized access to any portion of Service, or any trade area or membership area of Service.
Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.

Otherwise attempt to interfere with the proper working of Service.

We may use third-party Service Providers to monitor and analyze the use of our Service.

No Use By Minors

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Ministry of Agriculture and farmers welfare and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Ministry of Agriculture and farmers welfare.

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

14. DMCA Notice and Procedure for Copyright Infringement Claims

You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.
